Because most people are violating those rules and are creating massive tax liabilities for their clients. An obvious example is the material covered in the article on prohibited transactions. Due to the internal policies of the big investment houses, thousands of IRAs are probably being distributed each day.
But that's just the tip of the iceberg.
Consider something as basic as rollovers, each year the IRS probably issues a few hundred rulings on the errors made on a simple rollover. Along the same lines, the?Department of Labor says that if your current advisor asks you to rollover funds to them, there is a high probability that will cause a distribution as well. Or to change perspectives, if you are an advisor, and ask a current client to move their account to you, there is a good chance that you have caused your client's account to be distributed. In this case, what you don't know can hurt you. . . bad.
The second day is going to be a day in planning.
We are going to put all the negative stuff behind us and concentrate upon the multitude of opportunities for planning with large retirement plan assets. Like I said, if you want to learn about stretch IRAs don't bother showing up.
What we are going to do is start off with an analysis of?qualified retirement plans and show how easy they are to establish for your clients. The reason for the emphasis on qualified retirement plans is due to the incredible amount of flexibility offered to the qualified plans.
Want to move a lot of money out of the plan in a tax free manner? Why not use?life insurance in the plan? (You're not going to hear the numbers 412 or 419 cross our lips.) Don't like life insurance??How about the new rules regarding Roth 401k conversions, there is some really interesting material there.
Since we discussed life insurance, let's talk about?estate planning for large retirement plans as well. Did you know that most bankruptcy courts don't consider inherited IRAs valid IRAs? A direct result of this is those IRAs are going to be subject to the claims of creditors. We've got some simple solutions to that conundrum.
